On February 1, Giles County filed a statement in opposition to Mountain Valley Pipeline’s Request for Notice to Proceed No. 5, which was filed January 26 and clarified January 31.
The filing asks that the Director of the Office of Energy Projects deny this and any future Requests for Notice to Proceed in Giles County, citing them as “premature pending the Commission’s decision on the merits of the County’s rehearing request and Mountain Valley’s completion of pre-construction environmental conditions.”
Giles was one of several counties in Virginia to file on November 13 for a rehearing of FERC’s Certificate of MVP. On December 13, FERC filed the tolling order delaying consideration of rehearing requests indefinitely. The filing asserts that FERC should rule on those rehearing requests before any Notices to Proceed are granted.
Additionally, the filing states that MVP is still not in compliance with FERC Certificate Environmental Condition No. 15, and no construction should be allowed to proceed before that condition is met.
