Mountain Valley Pipeline filed Request for Notice to Proceed No. 7 on February 2, in which they ask for permission to proceed with construction of the pipeline in Pittsylvania County, as well as facilities in Montgomery, Franklin, and Pittsylvania Counties in Virginia.
MVP indicates in the filing that “following issuance of the Notice to Proceed, the timing of the actual construction may vary depending upon state permits.”
The company asks that the Notice to Proceed be issued by February 8, 2018.
Additionally, MVP filed Supplemental Materials relating to Environmental Condition No. 32 and a Revised Treatment Plan for North Fork Valley Rural Historic District.
Environmental Condition No. 32 stipulates the following:
Prior to construction, Mountain Valley shall file with the Secretary documentation that The Nature Conservancy (TNC) Property Crossing Plan was provided to the TNC for review and comment. (section 184.108.40.206)
Regarding the Treatment Plan for North Fork Valley Rural Historic District, MVP stated the plan was “substantially revised in response to the feedback received from Virginia Department of Historic Resources, the Advisory Council on Historic Preservation, and Montgomery County on the August 2017 version of the plan.”

Karen Maute of Danville, VA filed comments to MVP’s Request for Notice to Proceed No. 7 on February 7, 2018.
In her comments, Maute explains that FERC cannot grant MVP Notice to Proceed in Pittsylvania County because the company has failed to comply with the county zoning laws. She states that public hearings are scheduled in the county with the Board of Zoning Appeals regarding a Special Use Permit on February 13, 2018 and with the Board of Supervisors regarding a rezoning of MVP’s property at the proposed TransCo Interconnect.
Additionally, the company has not yet applied for Special Use Permits, which are required by Pittsylvania County’s Zoning Ordinance for properties with easements, and the Board of Zoning Appeals for the county has indicated they expect MVP to apply.
